Florida's lawsuit last week made headlines, but it wasn't the first. The list of states suing Discord has grown to six in 18 months, and most of them filed in 2026.
They all make a similar argument. Each state says Discord told parents it was safe while failing to keep adults away from children. One of them, Texas, has already won a court order that forces Discord to change how it treats teens in the state, with a 90-day deadline that falls this month.
Below is every case, side by side, with what each state wants, how Discord has responded, and what actually changes for you.
At a glance - States suing Discord: New Jersey, Nevada, Indiana, Texas, Arkansas and Florida - First case: New Jersey, April 2025 - Latest case: Florida, 15 October 2026 - Only court order so far: Texas, July 2026 - Common claim: misleading parents about safety under consumer protection laws - Discord's position: the suits don't reflect "the platform we have built" - Status: all claims are allegations. None has gone to trial

⚖️ What Each State Claims
New Jersey
New Jersey's attorney general opened the wave in April 2025. The state says Discord misled parents about safety features that didn't work as advertised, and didn't enforce its own ban on users under 13, New Jersey Monitor reported.
Nevada
Attorney General Aaron Ford sued in May 2026. Nevada claims Discord put growth ahead of safety, let adults privately message minors with few safeguards, and lets people make new accounts to dodge bans, according to FOX5 Las Vegas.
Indiana
Indiana's Todd Rokita sued Roblox and Discord together in May 2026. He says predators use both platforms to target children. The state wants civil penalties of up to $5,000 per knowing violation, WRTV reports.
Texas
Texas sued on 22 May 2026. In July it won an Agreed Temporary Injunction, a court order Discord agreed to while the case continues. More on that below.
Arkansas
Attorney General Tim Griffin announced a joint suit against Roblox and Discord on 22 June 2026. He called Discord the "escalation environment" in what he described as a two-stage predatory pipeline, KAIT reported.
Florida
Florida's James Uthmeier sued on 15 October 2026, claiming weak age checks and policies that weren't enforced. Florida is seeking penalties of up to $150,000 per violation where Discord knew a user was under 18. Our full breakdown of the Florida Discord lawsuit covers it in detail.
🤠 Texas Won First: What Discord Must Do
Texas is the only state with a court order so far. According to the Texas Attorney General, the 24 July order requires Discord to:
- Give all Texas users the same age-assurance and default safety protections it already gives UK users, within 90 days.
- Send messages from strangers to a separate request inbox.
- Block sensitive content for Texas teens and lock that setting unless the user is confirmed as an adult.
- Limit adult-only spaces to users it has age-assured.
- Report progress to the attorney general every 30 days.
Ninety days from 24 July lands around 22 October. In practice, Discord has already moved. Its 22 September announcement said it had launched age assurance in Texas and Brazil, alongside new teen protections worldwide.
The order isn't the end of the case. Texas still plans to seek civil penalties at trial.
🛡️ What's Already Changed on Discord
Most of what these states are asking for now exists on Discord, at least in part. Since 22 September, every account sits in an Adult, Teen or Unconfirmed age group.

Teen and Unconfirmed accounts get protections by default:
- Message requests for DMs from non-friends
- Sensitive content blurred or blocked
- Age-restricted servers and channels off limits until you confirm you're an adult

Discord says more than 90% of users won't be asked to confirm their age. Adults placed in the wrong group can confirm using options such as a credit card or an app store, without an ID or selfie.

🗣️ How Discord Has Responded
Discord's replies have been consistent. Responding to Nevada, a spokesperson said the suit "does not reflect the platform we have built or the investments we have made in user safety." It gave Florida a near-identical statement.
Discord also points out that it requires users to be at least 13, that most users are adults, and that it offers teen safety and family tools such as Family Center.
Family Center gives parents a weekly summary of a teen's activity, without message contents. Image: Discord.
👀 What It Means for You
If you're an adult: probably nothing. Most adults are placed in the Adult group automatically.
If you're a teen: expect stricter defaults, especially in Texas, where they're now required by a court order.
If you're a parent: Family Center and the teen defaults are already available. Lawsuits may push Discord further, but they move slowly.
If you run a server: age-restricted channels now need confirmed adults, so check your settings. Our AutoMod setup guide helps keep public spaces safe.
Frequently Asked Questions
How many states are suing Discord?
Six: New Jersey, Nevada, Indiana, Texas, Arkansas and Florida.
Which state sued Discord first?
New Jersey, in April 2025.
Has any state won against Discord?
Texas won an Agreed Temporary Injunction in July 2026. It forces safety changes while the case continues, but it isn't a final judgment.
Is Discord being banned in any state?
No. The lawsuits seek penalties and safety changes, not bans.
Why are states suing Roblox and Discord together?
Indiana and Arkansas say predators often meet children on Roblox and then move them to Discord.
🎮 The Bottom Line
The states suing Discord all want the same thing: proof that kids are protected, not just promises. Texas already has a court order, Florida just joined, and more states could follow.
Discord's new age groups and teen defaults answer many of these demands. The courts will decide whether they came soon enough.
Do you think lawsuits are what finally pushed Discord to change, or were these updates coming anyway?
